DAILY INCIDENTS FOR THURSDAY, JULY 30, 2009

No Curfew but a Warrant Will Keep You in the House

Last night, Wednesday, July 29, 2009 around 10:44PM, officers from District D-4 (South End) were on patrol in the area of Newbury Street when they observed an individual standing in front of 73 Newbury St. pressed up against the glass.

As officers approached the individual, he appeared to become alarmed and immediately started walking away from the window. Officers made note of the suspect’s behavior due to a number of burglaries that had occurred in the area by virtue of the front windowpane glass being broken. Officers circled the block to continue to monitor the area and again observed the same suspect standing again in front of 73 Newbury St. pressed up against the window. Again, the suspect became alarmed when e observed officers and attempted to walk away.

Officers then stopped their cruiser and approached the suspect to conduct a threshold inquiry. The suspect, when officers approached him, asked officers if there was a curfew in the area. Officers told him that there was not a curfew but due to several recent breaks in the area and his behavior, they’d be remiss in their duties if they didn’t conduct at least a threshold inquiry. Officers requested identification from the suspect and ran his information on the MDT (Mobile Data Terminal). The information revealed that the suspect, Peter A. Escott, 36, of Medford had an outstanding warrant for Breaking and Entering in the Nighttime, and as such was arrested and transported to the district station for booking.

Another Firearm Recovered

Around 11:04PM last night, officers from District B-3 (Mattapan) arrested suspect, Dana C. Sams, 32, of Dorchester and charged him with Unlawful Possession of a Firearm, Unlawful Possession of Ammunition, Possession of a Loaded Firearm and Operating a Motor Vehicle after Revocation.

Officers were on patrol in the area of 1583 Blue Hill Ave. when they responded to the rear of the Avenue Tavern as part of their patrol duties. There, officers observed a car with its engine running with someone inside. Aware of complaints of drug use in the area and the fact there are posted “no trespassing, no loitering” signs posted in the back of the building, officers approached the car to conduct a threshold inquiry. As officers approached the suspect immediately tried to get out of the car and walk away. Officers stopped the suspect and immediately detected a strong odor of marijuana on the suspect and emanating from the car. During the stop, officers could clearly observe that the suspect was shaking and demonstrated other signs of nervousness. Based on the smell of marijuana, the suspect’s location and his conduct, officers asked him if there was anything on him that he should not have. The suspect answered officers’ question and told them that he had a bag of marijuana on his person. Officers then asked the suspect id he had anything else on his person and he did not respond. At this same time, officers checked on the suspect’s information and determined that his license was revoked. Officers then conducted a cursory check of the suspect’s motor vehicle which revealed a loaded firearm.

The suspect was then arrested and charged with the above offenses and issued a citation for the marijuana.

Late Night Fireworks Lands Two in Jail

This morning around 2:09AM, officers from District D-4 (South End) responded to the area of 233 West Newton St. for a report of fireworks. Boston Police Operations had received numerous calls regarding fireworks along with several ShotSpotter notifications.

On arrival, officers were greeted by several people who complained about people “putting on their won fireworks show.” Officers were then directed to the rear of West Newton St. and there saw three spent fireworks tubes laying on the ground along with two live tubes on a table in the rear of 233 West Newton Street. Officers then knocked on the rear door of the basement apartment to further investigate, and received no answer. Officer then felt the doorknob and discovered the door to be open and unlocked. When the door opened officers noticed a male and a female on a couch surrounded by fireworks similar to the ones that had been observed outside.

Officers then entered the apartment and asked the occupants who had been setting off the fireworks. One of the two individuals replied and exclaimed to officers, “Fireworks? No fireworks here.” Officers then attempted to obtain information from the suspects in order to issue a city ordinance violation for disturbing the peace, but the suspects then became belligerent and refused to provide their information to officers. One of the suspect s then fled inside bathroom and attempted to lock herself in her bathroom. Suspect, Kai Zimmerman, 42, of Brunswick, NJ was arrested and charged with Disturbing the Peace and Possession of Fireworks while suspect, Suzanne Stuhler, 31, of Boston was arrested and charged with Disturbing the Peace, Possession of Fireworks and Resisting Arrest.

Statements from Police Commissioner Edward Davis

News Conference on July 30, 2009

Thank you all for being here today. We are also joined by several guests and I would like to thank them for their continued support and participation. Joining us here is Minister Don Muhammad, Karen Payne from the NAACP, Michael Kozu from Project Right and Detective Larry Ellison from MAMLEO.

On Tuesday July 28th the Boston Police Department placed Officer Justin Barrett on administrative leave pending the outcome of a termination hearing. On that day I was made aware that this officer admitted to being the author of correspondence which included repulsive racial slurs.

At that time and after a meeting with command staff, I moved immediately to take action and the officer was stripped of his gun and badge.

I was presented with a set of facts and believed that the appropriate and only response was to place the officer on administrative leave and set the wheels in motion for a full investigation. The officer is entitled to his due process and we will see that process through. There will be a thorough internal affairs investigation and hearing process which will lead to a termination hearing scheduled in the next week to ten days.

The Boston Police Department has a top to bottom commitment to community policing. Community Policing is based on trust. This type of venomous rhetoric is severely damaging. Maintaining our community relationships is paramount to our mission to serve the citizens of Boston.

We all work with the community and have made great strides to earn their trust. We must not allow this action to affect those relationships that have been forged and the progress we have made over the years.

The Boston Police Department is committed to a standard of excellence. Our community rightly has high expectations for us. It is a standard that the community deserves and we are required to meet. Officer Barrett’s actions do not comply with those expectations.

Barrett’s email was racist and inflammatory. These racist opinions and feelings have no place in this department or in our society and will not be tolerated.

Barrett’s comments were directed at Harvard University Professor Henry Louis Gates. I regret the direct insult toward Professor Gates and have personally reached out to him to apologize for this offense and inform him of the Department’s immediate efforts to make this officer accountable.

I have also asked that in the coming days, members of the department reach out to those in the community that we serve, and extend ourselves to others, to reiterate our commitment to them, our citizens and to improving relations at all levels.

As I have stated in the past, I am very proud of the Officers and civilians of this Department who carry out their duties in the finest traditions of the BPD. We will not allow the unacceptable actions of one member to define who we are as a police organization. This Department has over 2,000 uniformed officers and 700 civilians who conduct themselves with the utmost professionalism. I applaud your integrity and continued hard work.

As a department, we must learn from this most unfortunate incident and move forward.

Good Patrol Leads to Recovery of a Firearm

Early this morning around 12:04AM, officers from District B-3 (Mattapan) were on patrol when they observed four cars in the parking lot of Walgreen’s located at 825 Morton Street. Officers, knowing that the store was closed and that there are no trespassing signs posted, decided to further investigate. While approaching the cars, officers observed a male walking away from one of the cars putting his hands into his waist area.

Officers approached one of the cars and questioned the driver as to his purpose in the parking lot. The driver indicated to officers that he and the other cars were meeting there to go out. When officers asked the driver for identification, he stated that he did not have any identification on him and told officers that he thought that he had a suspended license. The driver provided officers a name and date of birth that showed no matching record with the Registry of Motor Vehicle. Again, when officers asked the suspect about his identity he insisted on the same name that he had previously given to officers. The driver continued to be evasive with officers as to his identity and purpose in the parking and after a while was asked to step out of the car.

Once out of the car, the operator was observed to have a wallet on his person despite his having told officers that he had no identification on his person. When asked about the wallet, the operator continued to be evasive and insisted that the wallet was another person’s who had no pockets. Based on the totality of the circumstances, officers asked the passenger to exit the vehicle to conduct a further investigation. Once the passengers were taken out of the car, officers conducted a cursory search of the car and discovered a firearm in the couch behind the driver’s seat.

None of the occupants possessed a license to carry and all told varying stories as to where they were in the car. Subsequently, officers arrested all three occupants. The driver who was later properly as identified as Frederick Knox, 21, of Roxbury was charged with Operating a Motor Vehicle with a Suspended License, Unlawful Possession of a Firearm, Unlawful Possession of Ammunition, Failure to Submit to a Police Officer, and Trespassing. The other passengers, Chazreyl Francis, 20 and Edward Molyneaux, 20 both of Dorchester were also arrested and charged with Unlawful Possession of a Firearm, Unlawful Possession of Ammunition and Trespassing.

After the operator, Frederick Knox was arrested he told officers he lied about his identity because he thought he had a warrant and that he lied because he really wanted to go to a party.

Call for Shots Fired Results in Recovery of Firearm

At approximately 1:12AM today, officers from District B-3 (Mattapan) responded to 71 Esmond St. in Mattapan for shots fired.

En route, officers were informed that three shots had been detected by Shotspotter, and that callers had described the suspect as a black male in his mid twenties with medium build wearing a white t-shirt with red designs on it. On arrival, officers a large crowd gathered around the house located at 71 Esmond St. filtering in and out of the first floor of the house. Officers started canvassing the area and went to the rear of the house where the suspect ran. While looking in the back yard, officers observed a male matching the suspect description standing on the third floor deck. Officers went to the third floor deck and spoke to the male up there. The male when questioned about what he was doing there told officer that he had been working the back door and ran to the third floor deck when the shots were fired. While conducting a threshold inquiry of this male, officers attempted to find the owner of the apartment to issue a civil citation for Keeper of a Disorderly. At this same time, officers found several shell casings and one live round in the alley next to the house. Based on everything that had preceded the officers’ arrival, and what they had discovered, they decided to do a cursory of the apartment to ensure that no one was hurt. Inside the apartment, officers found several individuals and detained them pending further investigation, included amongst those individuals was the male who matched the suspect description.

While officers were detaining this group, officers observed the same male matching the suspect description to be extremely nervous and sweating while seated on a bed waiting while officers checked his name. While watching the male suspect seated on the bed, officers noted that the mattress had a lump underneath. Based on the officers’ observations and the male’s nervous behavior, officers looked under the mattress and found a sawed rifle underneath the bed.

The suspect, Bell Kemp, 28, of Mattapan was arrested and charged with several outstanding warrants, and Unlawful Possession of a Firearm, and Unlawful Possession of Ammunition.

Escaped Prisoner Found Hiding inside a Coffee Table

Yesterday afternoon around 3:30PM, officers received a report that a prisoner at Roxbury District Court had used a ruse to escape from the court. Officers learned that the suspect had answered to the name of another prisoner, went before a judge and as a result was released from the court on personal recognizance.

Shortly after escaping from custody, members of the Boston Police Fugitive Unit started an investigation into the whereabouts of the suspect who was to have appeared before the court on charges ranging from Unlawful Possession of a Firearm to Violation of a Restraining Order. As a result of an exhaustive and thorough investigation members of the Fugitive Unit learned of the whereabouts of the suspect and responded to 12 American Legion Highway this morning around 11:15AM. FINGER PRINT LEFT AT THE SCENE OF THE CRIME LINKS 14 YEAR-OLD VANDAL TO DAMAGE DONE AT CITY PARK

On August 25, 2008, officers from Area E-5 (West Roxbury) responded to a radio call for a vandalism report in the area of 520 VFW Parkway (Hynes Field). On arrival, officers spoke to officials from the Boston Parks Department who stated that several trees in the park had been cut down and moved. Specifically, 10 trees (7 red maples and 3 honey locusts) had been cut and damaged. A search of the area enabled officers to locate and take possession of a hand saw. The hand saw was forwarded to the Boston Police Crime Lab for further analysis. Specifically, members of the Boston Police Latent Print Unit fumed the saw for latent print evidence. As a result of testing conducted at the lab, investigators were able to lift or recover a finger print belonging to the individual responsible for the damage done at the park. The prints were then forwarded to the AFIS (Automated Fingerprint Identification System) for a possible identification or match. However, no identification was forthcoming because the individual responsible for the vandalism likely had no criminal history or record.

Approximately, nine months later, on Saturday, May 2, 2009, officers from Area E-5 (West Roxbury) responded to a radio call for an individual or individuals breaking into cars in the area of 111 Willow Street. On arrival, thanks to assistance provided by an off-duty Boston Police officer, responding officers were able to locate the suspect. Officers arrested a juvenile and charged him with Breaking & Entering a Motor Vehicle.

Shortly thereafter, investigators were able to match the print recovered from Hynes Field (520 VFW Parkway) with that of the juvenile arrested in connection with the above mentioned incident. As a result, the juvenile, a 14 year-old male from West Roxbury, was additionally charged with the Willful & Malicious Destruction of Property and the Destruction of Playground Equipment.

Community Alert

Boston Police Report Increase in Theft from Motor Vehicles
BPD Offers Prevention Tips for Motor Vehicle Break-ins

From January 1, 2009 to July 1, 2009, statistics indicate that 5 out of 12 Boston Police Districts are reporting an increase in the number of Larceny from a Motor Vehicle. Seven districts have reported a decrease in the number of thefts from motor vehicles. This has resulted in a 6% increase of motor vehicle break-ins citywide. District D4 is experiencing the largest increase with a 52% increase.

Boston Police are increasing patrols to identified areas of concern. To address this issue, Boston Police Districts Commanders are also organizing sting operations utilizing decoy vehicles. In addition, the Boston Police ask community members to be mindful of safety tips listed below.

As stated above, five districts reported an increase in the number of thefts from motor vehicles. Citywide Larceny from Motor Vehicle Year To Date from January 1, 2009 – July 1, 2009 is available via media relations.

Boston Police reports indicate that the most common items stolen were left in sight and include: GPS Devices, lap tops, US currency (left on the dashboard or in an ash tray), stereos and stereo face plates, electronic devises (cell phones, ipods, blackberry’s and chargers), bags, purses and briefcases.

The Boston Police would like to take this opportunity to remind residents and visitors to our City that motor vehicle breaks are among the most easily preventable of crimes. They are typically crimes of opportunity, committed by thieves who look for valuables left unattended. Taking a few simple steps can often discourage these thieves. Here’s how you can protect yourself against motor vehicle breaks.

DO NOT LEAVE VALUABLES IN YOUR CAR WHERE OTHERS CAN SEE THEM. Valuable items, such as your laptop, iPod, etc. should never be left in the front or back seat of your vehicle. Always take your valuables with you, or move them into the trunk.

• Lock your doors and windows. Even if your window is only slightly open, it makes your car an easier target for thieves. A thief will insert a wire into a slightly open window to pop up the door lock.

• Replace your standard door lock buttons with tapered ones. Tapered door lock buttons make it more difficult for a thief to hook a wire or device onto the door lock button to pop it open.

• Invest in an anti-theft device. When you buy a new or used car, checking to see if it has an anti-theft device is as important as checking the engine. If there isn't one, you should have one installed.

• If you observe any unusual activity or observe a car theft or a break-in, call 911.

BOSTON POLICE CONCLUDES STEROID USE INVESTIGATION

Commissioner Davis Issues Multiple Suspensions

Today Boston Police Commissioner Edward F. Davis announces the conclusion of a three year investigation into steroid use among officers. In August of 2006, Boston Police Anti-Corruption Division in conjunction with the US Attorney’s Office and the Federal Bureau of Investigation developed information that launched a lengthy and in-depth investigation into this matter, which has resulted in multiple suspensions and several important departmental changes.

In addition to the conclusion of the steroid investigation, the Boston Police Internal Affairs Unit has completed the investigation into improper officer activity at 24 Factory Street in Hyde Park. Investigators identified 24 Factory Street as an after-hours party location which included allegations of officer misconduct. Evidence uncovered during the course of this investigation has also led to the suspension of several officers.

As a result of these investigations, Commissioner Davis has suspended seven police officers for steroid use, one police officer for being aware of steroid use by others and not reporting it and four police officers for issues related to 24 Factory Street.

Commissioner Davis stated, “I would like to commend the dedication and professionalism of the investigators in Anti-Corruption and Internal Affairs for the completion of this extensive and complex case. These investigators play a critical role in our promise to the community to provide an effective, credible and trustworthy police force,” Commissioner Davis added, “I am disappointed with the actions of the officers disciplined in this matter. With this chapter finally closed, the department will move forward with improved policies and practices resulting from difficult lessons learned. We remain steadfast in our dedication to preserving the integrity of our department by taking every measure to prevent and when necessary uncover officer misconduct.”

ACTION STEPS

The Boston Police Department has undertaken several initiatives to immediately address issues and concerns relative to steroid use by officers. The following actions have already been introduced into department practice and are currently ongoing:

Enhanced ‘Reasonable Suspicion’ training for all supervisors. Every Supervisor (Sgt, Lt., Captain, Command Staff member) has received expanded ‘Reasonable Suspicion’ training. The curriculum includes recognizing and addressing the signs of substance abuse specifically steroids and also corruption indicators. Supervisors are trained and expected as part of their duties to recognize distinct changes in officers which would require ‘cause’ testing for steroids. Every newly promoted supervisor receives this training
Enhanced ‘Integrity’ training for all supervisors. Every Supervisor (Sgt, Lt., Captain, Command Staff member) has received expanded ‘Integrity’ training. A curriculum was developed in conjunction with Federal authorities. Federal authorities also participate in the training and are present at the Academy to address supervisors. Every newly promoted supervisor receives this training.
Enhanced ‘Health and Wellness’ training for every officer. Every officer is now required to receive enhanced ‘Health and Wellness’ training at the academy that focuses on the health risks associated with anabolic steroid use.
Implementation of pre-employment steroid testing for recruits. Boston Police now include steroids in all pre-employment drug testing for potential recruits.
Enhanced curriculum for Recruits at the Police Academy. All recruits now receive an improved curriculum that includes education on the dangers of steroid use as well as expanded teachings relative to integrity and ethics issues.
Sought and secured ‘lifetime career’ testing for substance abuse police violation. Police Commissioner Davis sought to secure a contractual obligation of ‘lifetime career’ testing for any officer who violates the drug abuse policy. Commissioner Davis was successful through union negotiation to amend the policy to include this provision. Termination is the result of a second positive drug test.

PENDING STEPS

• Commissioner Davis continues to explore the possibility of including steroid testing in the annual drug testing policy. The department’s drug policy currently states the every officer receives an annual drug exam, which tests for almost every narcotic and controlled medication including cocaine, heroin and Oxycontin. The drug test uses a hair sample and has a 99% accuracy rate.
• Commissioner Davis supports the current bill before the legislation requiring the state to mandate drug testing for public safety employees. He encourages the Executive Office of Public Safety to include steroids as part of the testing mandate.
• The department continues to closely monitor the advances in science and technology relative to steroid testing.
• Staff at the Police Academy is developing a distance learning program for officers that will include curriculum devoted to the dangers of steroid use and also integrity and ethics issues.
