DAILY INCIDENTS FOR SUNDAY, MAY 31, 2009

Traffic Stop Leads to Arrest of Three for Trafficking

Last night around 9:48PM, officers assigned to District E-13, Jamaica Plain, responded to the area of 8 Haverford St. in Jamaica Plain for a fight. While on scene in the area of the call, officers observed a motor vehicle traveling at a high rate of speed fail to stop for a stop sign. Officers, having observed the violations noted above and feeling that the car may have been involved in the fight, conducted a traffic stop at the intersection of Germania and Brookside Avenues.

During the traffic stop, officers approached the operator of the car and requested of him his license and registration. While talking to the operator, officers detected a strong odor of alcohol coming from the car, and observed a bottle of beer at the foot of one of the passengers. In addition, officers also noticed that neither of the two passengers of the car was wearing seatbelts. The driver, despite having been asked for a driver’s license, handed officers a Massachusetts liquor identification card and stated to officers that he was not licensed to drive.
While speaking to the operator, officers noticed that the passengers along with the driver were extremely nervous. The operator was removed from the car to be placed under arrest for Operating without Being Licensed and the passengers asked for identification to be issued Seatbelt Violation citations. Both passengers denied having any identification, and thus were asked to get out of the car. One passenger, when asked to get out of the car, made a sudden move to his waist area. Officers now fearing that this passenger may be armed removed him from the car, and performed a cursory check of the car.

Officers recovered from within the car a paper towel which had three bags, two containing crack cocaine and another powdered containing cocaine. All three suspects, Christopher Walker, 42, of Roxbury, Jody L. McCarthy, 39, of Roxbury and Rasheed Marsman, 35, of Dorchester were arrested and charged with Trafficking Class B, Possession with intent to Distribute Class B, Possession with intent to Distribute Class in a School Zone, Possession of Class B, and Conspiracy to Violate Drug Laws. In addition suspect Marsman was charged with Operating a Motor Vehicle with a Suspended License while the other two passengers were charged with Seatbelt and Open Container Violations.

MURDER SUSPECT ARRESTED IN THE SHOOTING DEATH OF 15 YEAR-OLD SOHEIL TURNER

Boston Police Commissioner Edward F. Davis and Suffolk County District Attorney Daniel F. Conley today announced the arrest of a suspect responsible for the fatal shooting of 15 year-old Soheil Turner on May 7, 2009.

An extensive investigation by the Boston Police Homicide Unit, detectives from District B-2 and Suffolk prosecutors identified Xzeniyeju Chukwuezi, 18, of Roxbury as the suspect responsible for Soheil’s death. Based on evidence developed through relentless detective work and community cooperation, homicide detectives today secured an arrest warrant charging Chukwuezi with Murder and Unlawful Possession of a Firearm.

On May 7, 2009 at approximately 7:22am, officers from District B-2 (Roxbury) responded to a radio call at 305 Dudley Street for a person shot. Upon arrival, officers located a 15 year-old male victim suffering from what appeared to be two gunshot wounds. The victim was rushed to Boston Medical Center where he was treated for life-threatening injuries. Soheil was soon pronounced as a result of his injuries.

Commissioner Davis stated, “I would like to commend the dogged detective work and the dedicated efforts of Suffolk County prosecutors along with the commitment of detectives from the Homicide Unit, District B-2 and the Boston Police School Police Unit and community participation that led to the successful identification and apprehension of the perpetrator responsible for Soheil’s death,” Davis added, “I hope today’s arrest brings some small sense of peace to Soheil’s family and loved ones as they continue to mourn the tragic death of a life lost far too young.”

District Attorney Conley stated, “Soheil Turner's death can be treated as the end of one young life, or it can serve as a renewed call for peace and non-violence in the neighborhoods of our city. There is no good explanation or excuse for Soheil Turner's death, but we hope that today's arrest - while only the beginning of a process to hold his killer accountable - brings at least some small measure of comfort to Soheil's family and friends."

DAILY INCIDENTS FOR SATURDAY, MAY 16, 2009

OVER THE LIMIT – UNDER ARREST IN BRIGHTON

At about 2:38am, on Saturday, May 16, 2009, officers from Area D-14 (Brighton) observed a motor vehicle operating erratically and unpredictably in the area of Commonwealth Ave. Specifically, officers observed the motor vehicle drive onto and over an island along Commonwealth Ave. When the vehicle drove over the island, several pedestrians were forced to move so as to avoid coming into contact with the vehicle. Officers promptly activated their emergency equipment (lights & sirens) and stopped the car. With the car stopped, officers observed that the vehicle had a flat front tire. While speaking to the operator, officers noted that the operator appeared to be intoxicated given her slurred speech and glassy eyes. When asked where she was coming from, the operator stated, “A bar.” When asked if she had been drinking, the operator stated that she had had a ‘few’.

Officers then asked the operator to exit her car. With the operator outside the car, officers administered a field sobriety test. The operator was unable to pass the examination. When officers informed the operator that she had failed the exam, the operator stated, “It’s not your fault. I’m the one who was drinking.”

Officers arrested Autumn Brawn, 21, of Boston and charged her with Operating Under the Influence (Alcohol).

IPOD THIEF ARRESTED BREAKING INTO CARS IN THE AREA OF NEWBURY STREET

At about 7:05am, on Friday, May 15, 2009, officers from Area D-4 (South End) responded to a radio call for a black male, wearing a red plaid shirt, breaking into a black Audi in the area of 299 Newbury Street. On arrival, officers found and observed the car with the front passenger side window smashed and the contents of vehicle strewn about the interior of car. Officers also noted the presence of an IPod charger – minus the IPod – plugged into the car’s center console. In short time, responding officers observed an individual matching the description of the suspect. While approaching the suspect, officers noted that the suspect was listening, conveniently enough, to an IPod.

Officers asked the suspect where he got the IPod. To which, the suspect stated, “I got it at the store.” The suspect then stated that he was in possession of a second IPod as well. Officers also noted that the suspect was carrying a brown coat on which officers observed shards of glass in the pockets of the jacket.

Officers then accompanied the suspect back the scene of the car break. While on scene, a witness to the crime positively identified the suspect as the man seen breaking into the car.

Officers arrested Terry Graham, 46, of Boston and charged him with Breaking & Entering a Motor Vehicle, Receiving Stolen Goods and the Willful & Malicious Destruction of Property. The suspect was then transported to Area D-4 (South End) for booking. While officers were back at the station, a second victim entered the station to report a car break. According to the victim, similar to the other incident, her car window had also been smashed and her IPod stolen. Officers then showed the victim the second IPod recovered from the suspect. Upon seeing the IPod, the victim stated, “That’s mine.”

As a result, Mr. Graham was charged with an additional count of Breaking and Entering a Motor Vehicle and Receiving Stolen Property.

Message from the Police Commissioner

MAYOR MENINO AND COMMISSIONER DAVIS ANNOUNCE
INCREASED VISIBILITY AND ENFORCEMENT INITIATIVE

Speaking Points from Police Commissioner Ed Davis:
Despite substantial decreases in serious crime over the past two years, there remains a persistent and unacceptable problem in the use of guns that endangers our community.

It is outrageous that last night here in this very location, a three year old little boy while in his mother’s arms was struck with a bullet shot by a 16 year old with zero respect for human life. Thanks to our officers efforts specifically the members of the Bowdoin Safe Street Team that coward is right now where he belongs –incarcerated.

It is our intent that those perpetrators who share the same unabated willingness to participate in such violent firearm activity….will soon join the 16 year old, where these individuals belong…behind bars.
It is the men and women that are here before you today, in conjunction with many community partners, who are working tirelessly to stem gun violence. This year officers have made more than 250 firearm-related arrests and seized numerous firearms from city streets similar to the ones you see here before you today.

We are here today to share with our community the actions we are taking in response to an unacceptable recent increase in gun violence that has occurred in our community.

Mayor Menino and I are committed to immediately increasing visibility and patrols in areas most recently affected by firearm violence including Bowdoin Street, the Dudley Street area, Franklin Field, the Jackson Square area and the Norfolk Street area in Mattapan. Community members can immediately expect to see an increase in uniformed presence in and around their neighborhood.

The Boston Police Department in partnership with local, state and federal law enforcement agencies will execute a proactive warrant sweep specifically targeting fugitives who are wanted on drug and gang-related charges.

The sweep will utilize resources from Boston Police Youth Violence Strike Force, the Fugitive and Apprehension Team, the Boston Regional Intelligence Center, the Massachusetts State Police, the Parole Department, the Probation Department, the US Marshals and Boston Police Officers from the local District Stations.

I would like to express our thanks to these agencies for their ongoing support and efforts. This collaboration clearly highlights our joint commitment towards eradicating firearm activity and gang violence from city streets.

The goal of today’s announcement is to send a clear message to criminals that gun violence will not be tolerated in our community.

In addition to warrant sweeps and aggressive enforcement of impact players, the Boston Police Department is assertively undertaking the following initiatives to prevent further incidents:
• Community members will experience a significant increase of uniform presence.

• Homicide investigators are working around the clock to secure justice for the city’s homicide victims and their loved ones.

• The patrol force is closely monitoring the activity and whereabouts of known gang associates.

• Our intelligence unit along with state and federal partners are developing profiles of targets engaged in violent behavior.

• The Department and specialized units such as Crimestoppers will be proactively engaging community members by distributing anonymous Text-A-Tip pamphlets and keeping residents informed of ongoing efforts.

The Boston Police Department will not stand for illegal firearms on our streets or an individual’s determined readiness to use them.

Mayor Menino and I are here to reinforce to the community that we are taking every step necessary to punish the perpetrators responsible for these violent acts. We will not allow these cowards to derail our mission to reduce violence in the city of Boston.

Our officers are laser focused on their mission to eradicate firearm violence from our community. I am very proud of their hard work and the difference that they continue to make on behalf of all the decent people who live and work in our city’s neighborhoods.

We are calling on everyone in the community to play a role in reducing violence. Recently we have been encouraged by the brave community members taking a stand against these perpetrators. We must as a community heighten our resolve and continue that trend.

Through strong community partnerships and continued dogged police work we will achieve that goal.

After gaining entry, officers observed an apartment in total disarray, as well as, two males engaged in a physical altercation. Officers speedily separated the combatants. Specifically, officers observed the suspect repeatedly clutching at an object in his waist area. Officers then observed the individual enter a motor vehicle. Fearing that the individual may have been armed, officers decided to pursue the motor vehicle. While following behind the car, officers observed the motor vehicle fail to stop at a stop sign. As a result of the infraction, officers activated their emergency equipment (lights & sirens) in an effort to stop the motor vehicle. However, instead of stopping, the motor vehicle ignored the officer’s efforts to stop the motor vehicle. While following the car, officers observed the suspect’s car come into contact with a car stopped at a red light. At this point, the operator of the car exited the car in an effort to flee the scene. After a short foot pursuit, officers were able to apprehend the suspect.

On arrival, officers spoke to witnesses who stated that they believed the shots were fired from a black mini-van. Officers promptly broadcast a description of the black motor vehicle over all channels of the police radio. In short time, officers were able to locate a parked motor vehicle matching the description of the suspect’s black mini-van. Once on scene, officers felt the hood of the van and, upon touching it, noted that the engine was still warm. Officers Locate Firearm During Traffic Stop

Thursday, April 30, 2009, at approximately 9:16pm, Officers assigned to the Youth Violence Strike Force were on patrol in the area of Quincy Street when they observed a Grey Toyota Camry fail to signal a turn and proceed through a red light. The officers followed behind the suspect car and observed its rate of travel to increase. It was the officer’s opinion that the suspect vehicle was attempting to elude them. Due to a heavy volume of traffic, the suspect vehicle was forced to stop on Quincy Street.

Officers exited their unmarked cruiser and approached the suspect vehicle. Upon noticing the oncoming police presence, the suspect vehicle continued forward but was again forced to stop due to the traffic. Officers confronted the two occupants of the vehicle and observed them to be extremely nervous. It should be noted that this area is considered a high crime area involving violent gun related activity. A computer check of the operator showed an outstanding warrant for his arrest. Both occupants were asked to step from the vehicle. Both subjects continued to display extreme nervous behavior, which aroused the suspicion of the officers. The operator was asked to step to the rear of the vehicle several times before he complied. He was also observed looking around in a way, which was interpreted to locate an escape route. Officers then conducted a search of vehicle’s “lunge” area and located a loaded .9mm semi-automatic handgun. The weapon had a high capacity magazine that was loaded with several hollow-point .9mm rounds. It was later learned that the firearm was stolen out of Montgomery County (7/16/2008).
