BPD Officers Arrest One On Drug Charges

On Monday, March 30, 2009, Officers assigned to the Youth Violence Strike Force, were traveling on Harvard Street when they observed three males on the corner of Harvard / Westcott Street engaging, in what officers believed to be, behavior consistent with that of the illegal sale of narcotics. Officers observed the parties to conduct a hand-to-hand transaction before noticing the officers’ presence. One of the suspects then split off from the group and walked across Harvard Street towards Glenway.

Officers approached the suspect and called to him to stop. The suspect ignored the officers’ request and continued walking. As the officers got closer, the suspect placed the contents of his closed hand into his mouth. Officers recognized this to be a common practice for individuals to destroy illegal narcotics in their possession prior to a law enforcement encounter. The suspect quickly turned around and struck one of the officers with a closed hand. A struggle ensued and the suspect continued to strike officers before being placed into custody. During the struggle, the suspect spit out two (2) bags of crack cocaine, weighing approximately Seven (7) grams.

Officers arrested Carlos Banks, 36, of Boston on the charges of Possession of a Class B Substance (crack cocaine), Possession of a Class B Substance With Intent To Distribute Within 1000 feet of a School Zone (Sara Greenwood School), Assault & Battery on a Police Officer and Resisting Arrest. Incident Description:
About 8:35 a.m. on Thursday March 12, 2009 Officers Matt McCarthy and Mark Holbrook were flagged down on the corner of Shawmut Avenue and W. Dedham Street for an incident occurring on Shawmut Avenue.

Several people in the street were pointing toward the incident. Officers observed a woman, later identified as the victim, standing by the sidewalk crying, with a bed sheet around her. Officers then observed men wrestling with another man on the steps of this residence. Witnesses in the area yelled to Officers that the man on the ground tried to kill the woman and pointed to a large butcher-style knife lying on the ground. Robert Asbury, Eustace Fitzpatrick, Cristobal Vizcaino and Raul Estremera wrestled with the suspect, were able to take the knife away, flagged down the police and held him until the police arrived.

While working in the area, they heard some loud yelling and observed the suspect chasing after the victim down the stairs and out towards the street. The suspect grabbed the victim by the hair on the back of her head, bring her to the ground and attempted to drag her back towards the house. Community Connections

Officers from District B-3 Get To Know Local Youth

Officers from District B-3 (Mattapan) have spent the last several weeks getting to know local youth from the Franklin Field area. On Wednesday evening March 18, 2009, twelve Police Officers met with twelve young men ages 14-19 to share thoughts, concerns and experiences. The B-3 CSO officers have been working closely with these young community members over the past three weeks. The goal of the program is to enhance the relationship between youth and police so that the kids may come to know and trust the officers. In addition, it is an opportunity for the officers to get better acquainted with the youth and learn about their goals, dreams, and their concerns within their community.

This effort is a part of the The Youth & Police Initiative (YPI), a training created by NAFI/NFI to enhance police officers understanding of the beliefs, values, and experiences of local youth, while ensuring that youth develop a genuine regard for the challenges that police officers face on the job. Within this context, YPI provides structured dialogue, team building and role playing scenarios that allow all participants—youth and police—to tackle the real and hard issues of crime prevention and community policing.

For more information on this important initiative, please check out today’s column by Peter Gelzinis.

I would like to take this opportunity to commend each member of the Department who was involved in the excellent planning and execution of this year’s St. Patrick’s Day parade. The parade was a great success and your efforts have received numerous accolades from the South Boston community.

Officers on the street quickly and appropriately addressed issues that arose in a professional and efficient manner. Through past training and thorough preparation, the festive crowd was handled with precision and teamwork.

I would like to extend my gratitude for all of your hard work and your contribution to a remarkably successful event.

As demonstrated on parade day, the Boston Police Department is comprised of the most talented and committed individuals in law enforcement. I congratulate you on a job well done!

The 13 other Safe Street Teams cover the following geographic areas: Eagle Hill (A-7/ East Boston), two teams in Codman Square (B-3 Mattapan/Dorchester), Norfolk Ave and Blue Hill Avenue (B-3 Mattapan/Dorchester), Bromley Heath (E-13/ Jamaica Plain), Blue Hill/Talbot Ave/Franklin Field (B-3/ Mattapan/Dorchester), Lenox/1850 Washington (D-4/ South End), Dudley/Orchard Park (B-2/Roxbury), Downtown Crossing/Boston Common/Theater District (A-1/Downtown) Grove Hall (B-2/Roxbury) and Bowdoin and Geneva (C-11/Dorchester).

The locations of Safe Street Teams are selected using a data-driven process. Working closely with the intelligence unit and district commanders, geographic areas are chosen based upon concerns related to various crime over periods of time. Placing walking beats in these areas lead officers to develop a sense of ownership, engage in strategic problem-solving, sustained presence and guardianship. In addition, officers walking beats develop other competent guardians, such as local businesses owners and community members, who assist in enforcing safety standards.

Safe Street Teams allow officers to have sustained, meaningful contact with business owners and families and provide a valuable opportunity to address quality of life issues effecting local residents. The Sergeants for each team will have the ability to determine whether their team each night will walk the beat or use bicycles. Each ‘Safe Street Team’ is considered a long-term assignment.

Auto Service Center Cited for Issuing Inspection Stickers At Inflated Prices

Within recent time, BPD officers assigned to Area B-2 (Roxbury), received information that Anthony’s Auto Repair, 120 Blue Hill Avenue, was issuing Massachusetts Inspection Stickers at inflated prices to vehicles that would not normally pass the typical inspection process.

Based on this information, The BPD, in conjunction with the Registry of Motor Vehicles, launched an investigation targeting Anthony’s Auto Repair Service.

On Tuesday, March 10, 2009, an undercover BPD officer went into Anthony’s Auto Repair Service posing as a customer in need of an inspection sticker for her Dodge Caravan. Prior to entering the target location, the vehicle was inspected and it was determined that it did not qualify for a valid Massachusetts inspection sticker due to the dark tint of its windows.

The owner of Anthony’s Auto Service, Rafael Encarnacion, inspected the undercover officer’s vehicle and informed her that it would not pass because of the dark window tint and a faulty horn. The undercover informed Mr.Encarnacion that she really needed the car to pass the inspection. Mr. Encarnacion then informed the undercover that he would give the vehicle a sticker if she agreed to pay Eighty-Dollars ($80). The state fee for a Massachusetts inspection sticker is Twenty-Nine-Dollars ($29). The undercover agreed to pay the $80 and was given an inspection sticker in return without any work being done on the horn or the window tint being removed.

Rafael Encarnacion, 25 of Boston was informed by officers that he was going to be summonsed into Roxbury District Court on the charge of Larceny under $250. The Registry of Motor Vehicles also suspended Mr. Encarnacion’s permit to issue Massachusetts inspection stickers.

The current fiscal crisis that has plagued the country has left the City of Boston with no choice but to reduce personnel and non-personnel costs. At this time the Boston Police Department will be eliminating civilian positions and disbanding and relocating units. However, it is still unclear whether any additional cuts will be necessary during FY2010.

• 40 police cadets will be laid off as of July 1, 2009 and 4 police cadets will remain with the Department until January, 2010 to allow them to complete the 2 year cadet program.
• The Mounted Unit will be disbanded. 9 hostlers and 1 storekeeper will be laid off as of July 1, 2009. The 10 officers and 1 supervisor currently assigned to the Mounted Unit will be redeployed to the Districts.
• The Operations Division Neighborhood Interaction Unit that is responsible for taking calls on minor offenses and property crimes will be disbanded. 10 civilians will be laid off as of July 1, 2009. Those calls will be handled by the Districts.
• The Hancock Street facility will be closed as of July 1, 2009. A number of options for relocation are currently being evaluated.
• The Anti-Corruption Unit will be moved to another location.

The City’s Labor Relations Department is actively negotiating with Department employee unions. Federal funding made available to the City has decreased the likelihood and scope of layoffs of sworn personnel. No final decisions can be made until the status of federal funding has been determined and negotiations with public safety unions has been completed.

While we recognize the important contributions these units have made to the City of Boston, these difficult and trying times necessitate this action. The Department’s Human Resources Division is working closely with the City to ensure that those most impacted by these budget cuts are provided with as much information and assistance as possible. I will continue to update you as more information becomes available.

Officers responded to the driver side of the suspect motor vehicle and opened the car door to speak to the operator. Officers were immediately struck with a strong odor of alcohol on opening the car door. Officers asked the operator to get out of the car and as she did so they noted that she was unsteady on her feet such that she had to be supported to maintain her balance. When speaking to officers the operator spoke incoherently and continued to emanate a strong odor of alcohol from her breath. Officers then observed three open containers of alcohol in the suspect’s car.

Officers arrested the suspect, Ramona R. Cruz, 36, of Dorchester and charged her with Operating Under the Influence of Alcohol. The suspect’s vehicle was towed and officers later learned that her car was uninsured, unregistered and the plates were attached, and that she did not have a license. While speaking to the passenger, officers detected strong odor of fresh marijuana and asked the passenger to step out of the car. As the passenger exited the car he stated to officers that he had some marijuana on his person and stared removing a plastic bag from his coat pocket. Officers then performed a search of the passenger during which they recovered six individually wrapped plastic bags of a substance believed to be crack cocaine. Officers then asked the suspect if he had anything on him to which he did not respond.
