Noticing this behavior, officers decided to conduct a pat frisk of the subject to ensure their safety. As officers were attempting to conduct a pat frisk of the subject, he again started backing up and tried to reach into his back pocket. The occupants were removed based on the above-mentioned observations to conduct a pat frisk for the presence of any more weapons and/or contraband. Officers removed the occupants and attempted to pat frisk the passenger that had been holding the open bottle of bee. That individual then started backing away from officers as they attempted to pat frisk him and increasingly became more nervous. Officers then secured that individual and asked him if he had any weapons or contraband on his person at which time he stated, “Yes, it’s on my right hip.” Officers then recovered a loaded semi-automatic firearm.
