EXCESSIVE WINDOW-TINTING LANDS ONE IN CUSTODY

At about 2:00am, on Thursday, November 29, 2007, officers from Area B-2 (Roxbury) observed a motor vehicle with an expired inspection sticker traveling along Linwood Street. As a result, officers activated their emergency equipment (lights & sirens) and stopped the car. As officers were approaching the motor vehicle, officers observed the tinting on the motor vehicle’s windows to be well above the legal limit. A test of the window’s tinting, through the use of a tint meter, showed that the tinting was, in fact, illegal. When officers asked the operator of the motor vehicle to produce a driver’s license and registration, the operator stated, “I don’t have one on me.” An inquiry via the MDT (the computer inside the cruiser) showed the individual’s license to be suspended. A search of the motor vehicle enabled officers to locate a large double-edged sword.

Officers arrested Kevin Sutton, 22, of Dorchester and charged him with Operating after License Suspended and Possession of a Dangerous Weapon. Additionally, officers issued citations for Excessive Window Tinting and Invalid Inspection Sticker.

At about 11:10pm, on Thursday, November 29, 2007, officers from Area D-4 (South End) responded to multiple radio calls complaining of loud music in the area of 587 Beacon Street. On arrival, upon exiting their cruiser, officers could hear loud music emanating from the above mentioned address. Specifically, officers could clearly hear the song, “In the Air Tonight” by Phil Collins. As officers entered the address, officers were met by several disgruntled neighbors. In fact, one neighbor stated, “Please do something about this. It’s like this every night.” When officers knocked on the door responsible for the music, it took the occupant approximately 15 minutes to answer. When the suspect did answer the door, he immediately became belligerent and argumentative with the officers. When officers asked the individual to produce identification, the suspect stated, “I don’t have an ID and I don’t have to show it to you.” Officers again asked the individual to provide some level of identification. To which, the suspect, again yelling and shouting, stated, “I don’t live here.”

Officers arrested Jonathon Nicholas Toledo, 22, of Boston and charged him with Disturbing the Peace and Being Disorderly. Upon further investigation, with regard to prior calls for service, officers learned that 12 calls had been made regarding the same address.

On the morning of Wednesday, November 28, 2007 around 6:47am, officers from the Youth Violence Task Force (Gang Unit) went to 12 Magnolia St. in Roxbury to execute an outstanding arrest for a juvenile wanted by the Department of Youth Services.

On arrival, officers were allowed entry by the juvenile’s mother who directed officers to his room. Prior to officers arriving at the juvenile’s room, he came out and met officers in the hallway of the apartment. Officers re-entered his bedroom with him to allow him to dress properly before being placed under arrest. Once in the room, officers conducted a “protective sweep” of the room to ensure that the suspect had no weapons within arm’s reach that could be used against them. During this protective sweep, officers recovered a sawed-off shotgun.

A 16 year-old juvenile from Roxbury was arrested and charged Possession of a Sawed-Off Shotgun, Failing to Properly Secure a Firearm in addition to the Department of Youth Services warrant.

Officers maintained their position to see what would transpired, and shortly thereafter observed the suspect approaching another male who was in the parking lot all the while ducking and running as if to avoid being detected. As this was happening, the first individual who had crossed the street then drove in the direction of the suspect.

Having observed this, officers quickly made their way toward the suspect and the car at which point the car quickly drove off. Officers made contact with the suspect, and conducted a “pat frisk” at which point, the presence of an object feeling like a gun was immediately detected in suspect’s right front pocket. Officers secured the suspect and recovered a loaded semi-automatic handgun.

Yesterday afternoon around 4:47pm, officers from District C-11 (Dorchester) working as part of the Bowdoin Safe Street Team were alerted via police radio that the mother of a victim of a robbery that had taken place on the MBTA had just observed the suspect in the area of Bowdoin St. and Downer Court.

High Powered Rifle Recovered During “Routine” Call

Last night, Wednesday, November 28, 2007 around 6:43pm, officers responded to 202 Norwell St. in Dorchester for a complaint of marijuana smell/smoke and a reported history of past problems with the reported unit.

On arrival, officers went to the reported apartment, knocked on the door and were stricken with a strong odor of marijuana when an occupant opened the door. The occupants allowed officers in the apartment where they were overwhelmed with the smell of marijuana. Once in the apartment, one of the two occupants was very evasive with officers giving officers a false name and date of birth. When questioned about the reason for the lies, the male occupant of the house admitted to having an outstanding warrant for unlawful possession of firearm, and additionally stated that the female occupant had also been charged with unlawful possession of a firearm but had had cleared her cases.

Based on the statements given by one of two occupants regarding the gun charges, the behavior of both occupants, the overwhelming smell of marijuana, and the evasive answers and lies told to officers by occupants of the house, officers asked the occupants if there was anything in the house that they should be concerned about, specifically any firearms and they were told “No! Go ahead and search!” Both occupants assisted officers in a partial search of the room, but limited where they directed officers’ attentions. While conducting this protective sweep of the apartment, officers’ attentions were drawn to open closet with a large black bag standing. Officers felt this bag and by the sense of touch determined that the contents of the bag were consistent with a rifle. This was confirmed when officers opened the bag and it was determined that the rifle in the bag was in fact a high powered semi-automatic rifle with three high capacity magazines, two of which were loaded with 28 and 25 round s of ammunition.

Officers arrested suspect, Roberto Rodriguez, 24, of Dorchester and charged him Unlawful Possession of Firearm, Unlawful Possession of Ammunition, and Unlawful Possession of a High Capacity Magazine and several outstanding warrants.

Message from Police Commissioner Ed Davis

The following message is a statement from Police Commissioner Ed Davis delivered to the men and women of the Boston Police Department. This message will be played at officer's roll call at districts citywide.

An Internal Message from the Police Commissioner

I would like to inform all of you of the latest development in the Pulido case. Today at federal court Roberto Pulido entered a guilty plea on charges that resulted from a thorough and intense investigation conducted by the Boston Police Anti-Corruption Division and Federal authorities. A thorough and expedient investigation of allegations exposed during the trial is ongoing.

Pulido is facing a mandatory minimum sentence of 15 years incarceration and sentencing will take place in February. While it is a sad day for the department when a criminal hides behind a badge, I am proud of the swift and certain justice made possible by the combined efforts of the US Department of Justice, the FBI and the Boston Police.

I recognize that the last several days have been difficult for all of you who wear your uniforms with pride. We will not allow the loathsome actions Roberto Pulido and company to define who we are as a police organization. Our organization has over 2,000 officers who conduct themselves with the utmost professionalism. I applaud your integrity. I am proud of the work you have done in uncovering this corruption as well as the work you have done to reduce serious crime in Boston this year.

Police misconduct is an assault on public trust and strikes at the heart of community policing. Our department will not stand for it. These former officers are paying a heavy and appropriate price for their actions. I will continue to press for the strictest sanctions against police corruption so that the excellent police work that I see every day from our officers will not be tarnished.

Earning public trust requires that we perform our responsibilities professionally and with integrity. We will continue to vigorously and proactively identify and pursue any indications of corruption or mismanagement. Effective community policing requires that we hold ourselves to a high standard so that we will engender credibility with the community we serve. I reiterate, any time misconduct is uncovered it will be dealt with swiftly, forcefully and aggressively.

Our department is rightfully defined by the heroism and selfless service to the community that each of you exemplifies every day.

Here are some examples of the tremendous police work that defines the Boston Police that I have come to know.

The recent Red Sox series was a huge success. The extensive planning and precision with which the plan was carried out is a national model for best practices for police departments across the country. That is a credit to each of you.

I would like to recognize the members of the Boston Police homicide unit for their tireless efforts to secure justice for homicide victims and their families. In the last two weeks alone detectives have arrested SIX individuals for murder.

On November 1, 2007 two vigilant officers quickly apprehended a suspect after an armed robbery and murder at Stalex pizza in Dorchester. Their swift actions quickly removed an armed and dangerous suspect from the community and for that they deserve to be applauded.

On September 19, 2007, Mayor Menino officially declared “Officer Peter Giannopolous Day” in honor of the officer’s swift action to foil an attempted abduction of a young woman.

On September 21, 2007 two officers working a paid detail in East Boston quickly apprehended an individual suspected of a series of sexual assaults.

On October 19, 2007 the Safe Street Team assigned to Codman Square heard five consecutive gunshots nearby. The team immediately ran toward the sound of gunfire and apprehended a suspect in possession of a loaded firearm. The officers quick actions may have prevented further crime and saved a life.

On May 23, 2007, Officer Steven Romano assigned to the Youth Violence Strike Force was shot in the line of duty. Officer Romano has thankfully since recovered and returned to work fully prepared to resume 100% of his duties. Officer Romano personifies the qualities that are pervasive throughout this department.

So far this year, officers have removed 686 guns from city streets. We all know that your efforts have saved countless lives.

The Boston Police Department is dedicated to ensuring that “integrity” and “Boston police” are synonymous terms. I am very proud of all of you and I am personally thankful to have the opportunity to lead this remarkable organization. The possibilities are endless with your talent and commitment. As a department, we must learn from this and move forward. Our focus remains on reducing violent crime and making the neighborhoods safe for the citizens we are sworn to protect.

POLICE IMPERSONATOR CHARGED AFTER ARREST BY REAL POLICE

BOSTON, Nov. 7, 2007—A Lynn man was held on a total of $31,000 cash bail today after his arrest for allegedly robbing people while claiming to be a police detective, Suffolk County District Attorney Daniel F. Conley announced.

ANTHONY T. BURNEY, 32 (D.O.B. 6/28/75), was charged with two counts of unarmed robbery and single counts of impersonating a police officer, kidnapping, and larceny over $250 at his arraignment today in the Boston Municipal Court. The charges stem from three incidents in the downtown area dating back to early October, Conley said.

On the evening of Nov. 2, Burney allegedly approached a 22-year-old Walpole man and his 20-year-old girlfriend as they were parked near West and Mason streets. After identifying himself as “Detective Johnson,” Burney allegedly said he knew the victim had an outstanding warrant for “conspiracy to distribute drugs.” Burney then allegedly took a total of $203 in cash from the man, told him to spread his legs and frisked him, and ran away into the Boston Common.

The next night, Burney allegedly approached a group of five men who were drinking beer in the grassy area near the intersection of Charlesgate East and Ipswich Street. After flashing what appeared to be a badge and again proclaiming himself to be a police detective, the men said, he told them they could get in trouble for drinking in public.
“I don’t want to bust your balls,” Burney allegedly said, “so just cooperate and I’ll see what I can do.”
Burney then ordered the men to spread their legs and stand against the wall, they later told police. Burney allegedly demanded their wallets – from which he took a total of about $350 and two driver’s licenses – and took three men’s cell phones.

After robbing them, Burney allegedly ordered one of the men, a 38-year-old Fitchburg resident, to come with him on foot while the others remained at the scene. That victim described a long and bizarre trip marked by numerous left and right turns during which Burney occasionally pushed him along, called him “Ozzie,” and made him hold Burney’s jacket.

“I know some of your buddies have drugs on them,” Burney allegedly told the victim. “Give them up and I won’t arrest you.”

Burney also allegedly made the victim touch an open wound on Burney’s right forearm. The victim described it as “a gash, it was a flap of skin with pus coming out … but it wasn’t actively bleeding.”

At some point, the men boarded an MBTA Green Line train, disembarked, and boarded another, finally exiting at Boylston Station. Burney allegedly ordered the victim to remain there and gave him back the three cell phones.
“I have to go run some license plates,” Burney said by way of explanation.

In addition to these incidents, Burney was also charged today with the Oct. 3 theft of a number of shirts from the Newbury Street Niketown store, valued at about $1500.

Burney was arrested late yesterday after several victims picked his photograph out of arrays presented to them by real Boston Police detectives.

“Bizarre as these incidents may seem, they show that certain individuals will exploit people’s trust in law enforcement,” Conley said. “Fortunately, none of these victims were hurt.”
Burney is represented by attorney Arnold Cohen. He will return to court on Dec. 4.

TIPS TO PROTECT YOURSELF FROM POLICE IMPERSONATORS

Those who impersonate police officers erode the public’s trust in law enforcement and may endanger unsuspecting people. There are several tips you can remember to protect yourself during a traffic stop while helping your police officers do their jobs.
• Make sure it is a marked police unit. If it is not a marked unit, the emergency lights should be built in and are usually not a temporary light placed on the vehicle.
• Try to stop in a well-lit area or a location where there are a lot of people present.
• Turn on your emergency flashers but don’t turn off your car.
• Do not get out of the vehicle to meet the officer. Officers usually don’t like this anyway.
• Lock your door.
• Look for a uniform, official department jacket, and other equipment used by police officers for the performance of their duties.
• If the officer is in plainclothes, look for identifying clothing and equipment. If unsure, explain to the “officer” that you are unsure about the situation and ask them to display official department identification and badge. Ask where they work and if you can contact their dispatch center to confirm their identity. You may also request a marked patrol unit respond.
