MAN CONVICTED OF MURDERING TEEN OUTSIDE DOWNTOWN CINEMA

Press Release from Suffolk County District Attorney Daniel F. Conley

BOSTON, April 26, 2006—A man who shot and killed a teenager outside a downtown cinema will spend the rest of his life in prison after a Superior Court jury convicted him of first-degree murder and other charges this afternoon.

Jurors deliberated for parts of two days before convicting DARRYL SCOTT, 25 (D.O.B. 4/13/81), with the December 2002 shooting of 18-year-old Nabil Essaid outside the Loews Theatre on Tremont Street. Scott was also convicted of assault with intent to kill, assault with a dangerous weapon, and unlawful firearm possession and ammunition charges in connection with the murder and with his February 2003 arrest – when he pointed the same gun he had used in the murder at pursuing police officers and then put the gun to his own head in a Dorchester alley before surrendering to hostage negotiators.

Immediately after the verdict was read at approximately 3:30 p.m., Scott become violent in the courtroom, pushing the table he was sitting at and resisting an attempt by a court officer to handcuff him. He continued to resist for about a minute, flailing wildly and shouting obscenities as several court officers were required to restrain him and remove him from the courtroom.

Scott will be sentenced tomorrow morning in Courtroom 808 of Suffolk Superior court before Justice Charles Spurlock. He faces the mandatory term of life in prison without the possibility of parole and additional sentences for the assault and firearms convictions.

Jurrors convicted Scott, a Mattapan resident, after listening to a presentation of evidence by Assistant District Attorney Edmond Zabin that showed that on the evening of Dec. 14, 2002, the defendant opened fire on Essaid and his friends as they stood outside the Loew’s cinema. One bullet fired by Scott from a .40 caliber semiautomatic handgun hit Essaid, a Revere resident. After the shooting, Scott ran away down Tremont Street, toward Government Center, past a crowd of people on the sidewalk.

The fatal shooting followed by several weeks an earlier assault of Essaid at the hands of the defendant. In that earlier incident, Essaid and two friends were leaving the Downtown Crossing MBTA station when Scott pointed a different handgun at Essaid and tried to rob him.

On the night of the murder, evidence showed that Scott emerged from the theater’s lobby around 7:30 p.m. while Essaid and two friends were smoking cigarettes outside. Scott walked up to Essaid, said “remember me,” and sparked a confrontation that ended with Scott taking the .40 caliber out of his waistband, racking it, and firing in quick succession at Essaid’s two friends, missing them, and then at Essaid, hitting him once in his stomach and causing his death.

Scott was arrested on Feb. 6, 2003, after Boston police drug detectives tried to speak to him after conducting surveillance of him and another drug suspect on Bowdoin Street in Dorchester. After the officers approached Scott and identified themselves, he ran away, reaching for something in his waistband area as he did so.

During the ensuing foot chase, Scott reached into a holster on his waistband and drew a Glock .40 caliber handgun. He pointed the gun at pursuing officers. Scott hid under a tarp in the alley; as officers entered the alley, he jumped out from under the tarp holding the gun to his head and said he did not want to go to prison for life. Eventually, with the help of hostage negotiators and his father, Scott surrendered.

Technicians later matched the gun taken from Scott after his arrest to ballistics evidence from the murder of Essaid and attempted murder of his two friends outside the theater.

JURY CONVICTS DEFENDANT, 18, IN MURDER OF 15-YEAR-OLD

Press Release Issued by Suffolk County District Attorney Daniel F. Conley

BOSTON, April 26, 2006—A Suffolk Superior Court jury this afternoon convicted a Roxbury teenager of first-degree murder in the fatal shooting of a 15-year-old boy in Dorchester in the summer of 2003, District Attorney Daniel F. Conley said.

After deliberating for three days, jurors found that KENTEL WEAVER, 18 (D.O.B. 7/29/87), fatally shot Germaine Rucker. Jurors also convicted Weaver of unlawful possession of a firearm.

Weaver will be sentenced to the mandatory term of life in prison without the possibility of parole, and faces an additional sentence for the firearm conviction, at his sentencing hearing on Monday.

During several days of testimony, Assistant District Attorney John Pappas presented evidence showing that Weaver was among a group of youths from the Dudley Street neighborhood who approached Rucker on Wendover Street on Aug. 10, 2003. Rucker, who was on his bike, was alone and carrying a knapsack. Inside the bag were necklaces that he was selling.

Evidence showed that Weaver and his friends, in an unprovoked attack, knocked Rucker to the ground and began to beat him. One of the assailants said “where’s the bag,” then ran off with it. As Rucker was on the ground, Weaver, who was 16 at the time, shot him twice, in the back and head.

Weaver then ran away down Humphrey Street. A witness observed a person who was running down that street stumble, drop a gun and a Detroit Tigers baseball hat, pick up the gun, and continue to run, leaving the hat behind. Police recovered the hat later that night. A police officer testified at trial that Weaver had been wearing the same hat – which had distinctive extra lettering on its sides – when he was arrested for an unrelated prior crime. DNA testing done on the hat also linked it to Weaver, who himself later acknowledged ownership of the hat in an interview with police.

A Boston police detective testified at trial that Weaver, in a subsequent interview admitted to shooting Rucker. In convicting Weaver, jurors rejected a defense argument that the defendant confessed because his mother believed him to be involved and coerced him to do so.

Fact Sheet on Human Trafficking

This site has posted a few items concerning human trafficking. Which eventually led to the question “What exactly is human trafficking?”

Attached is a fact sheet on human trafficking prepared by the Boston Area Anti-Human Trafficking Task Force. The fact sheet explains what human trafficking is, what it isn’t, and how to help victims. For example:

Many victims of trafficking are exploited for purposes of commercial sex, including prostitution, stripping, pornography and live-sex shows. However, trafficking also takes place as labor exploitation, such as domestic servitude, sweatshop factories, or migrant agricultural work. Traffickers use force, fraud and coercion to compel women, men and children to engage in these activities… Trafficking is not smuggling. There are several important differences between trafficking and smuggling.

Human Trafficking Fact Sheet
Human trafficking is a modern-day form of slavery. Victims of human trafficking are subjected to force, fraud, or coercion, for the purpose of sexual exploitation or forced labor. Victims are young children, teenagers, men and women. After drug dealing, human trafficking is tied with the illegal arms industry as the second largest criminal industry in the world today, and it is the fastest growing.

The Trafficking Victims Protection Act of 2000 (TVPA) defines “Severe Forms of Trafficking in Persons” as:

  • Sex Trafficking: the recruitment, harboring, transportation, provision, or obtaining of a person for the purpose of a commercial sex act, in which a commercial sex act is induced by force, fraud, or coercion, or in which the person forced to perform such an act is under the age of 18 years; or

  • Labor Trafficking: the recruitment, harboring, transportation, provision, or obtaining of a person for labor or services, through the use of force, fraud or coercion for the purpose of subjection to involuntary servitude, peonage, debt bondage or slavery.

Trafficking Victims
Approximately 600,000 to 800,000 victims annually are trafficked across international borders worldwide, and between 14,500 and 17,500 of those victims are trafficked into the U.S., according to the U.S. Department of State. These estimates include women, men a
