On Friday, February 24, two incorrect locations were listed in a chart illustrating several shootings that have occurred within a specific geographic area in District B-3.

Below is a listing of the locations in question, along with the correct locations

1/8/06 shooting listed as occurring at Hosmer St (victim residing at Clarkwood St).
There has been no shooting documented on Hosmer St or Clarkwood St on 1/8/06. The only shooting that has been documented as occurring that day is a triple shooting that occurred at 244 Kelton St, District 14.

A shooting that occurred on 2/16/06 is reported as taking place at Clarkwood St.
The incident took place at 60 Clarkson St in District C-11, placing it outside of the Triangle area mentioned in the accompanying article.

The Triangle area that is referred to in the article is indeed an area of the City that is among the hardest hit by violent crime, and we appreciate any effort to bring attention to the criminal behavior that is negatively impacting these residents. However, it should be noted that since 11/16/05 there have been no reports of people shot within that Triangle area.

Event Recap: Student Forum At Emerson College

Emerson_2.jpg

On Tuesday, Commissioner Kathleen M. O'Toole met with approximately 100 students from Emerson College.

The goal of this forum was to facilitate an open dialog between the Boston Police Department and Emerson students. Joining Commissioner O'Toole was Captain Bernard O'Rourke, Commander of District A-1. The evening included discussions on a number of topics, including:

Quality of Life enforcement in the Theater District
Commissioner O'Toole discussed the Boston Police Department's commitment to the Broken Windows theory of policing, and how much of the quality of life enforcement is a direct response to specific concerns raised by members of a particular community. The most persistent complaints in any community are often for the so-called “minor offenses”, such as graffiti, vandalism, and public intoxication.

The new Citation Book being issued to Boston Police officers
Officers now have the option to issue citations for misdemeanor offenses. For students, this means that police have an intermediate step to address infractions, rather than resorting to arrest.

Drug dealing and prostitution in and around the Theater District, the Boston Common, and the Public Gardens
Students expressed concerns about the activity surrounding their campus, including the Boston Common. Commissioner O’Toole and Captain O’Rourke discussed the deployment of officers in the area, and several enforcement initiatives that may be underway at any given time, including

  • Operation Rolling Thunder, in which a targeted area is saturated with officers for a limited time.
  • The use of intelligence to target the time and place of specific crimes
  • The transient nature of the drug dealers in the area
  • The existence of directed patrols in the area, including undercover operations
  • The focus that the Department places on many of the clubs that operate in that area.

Treatment options for people arrested for drug violations
Students expressed concerns that incarceration of offenders may not address any underlying substance abuse issues.

Security plans for the bio lab currently under construction in Boston
A security plan is in place, and will be continually updated as the construction proceeds.

Boston Police Department policies on diversity, use of force, and processing of complaints against police officers.
Students were informed of efforts by the Department to enhance the diversity of our workforce, so that we better reflect the community we serve. Commissioner also discussed efforts to ensure that complaints against officers are properly investigated, as well as the number of complaints that that were sustained in recent years. A more detailed accounting is provided in our 2004 Annual Report.

Youth Violence
Students also asked for information about how they can get involved in preventing crime, and how to help stop the youth violence occurring in some of our neighborhoods.

Welcome Emerson College Students

Thank you to everyone who attended last night’s forum with Commissioner O’Toole.

The forum was an open dialog between the Boston Police and Emerson College students on several issues of concern, including the quality of life in the Theater District and police expectations of student behavior.

One of the topics we addressed was the issue of youth violence in our communities; specifically, what can college students do to get involved.

As discussed, we would love to see college students get more involved in the lives of young people in our communities. Activities such as mentoring, Big Brother and Big Sister programs, and volunteering at community youth centers and Boys and Girls clubs would be an excellent way for college students to get involved.

We strongly believe the younger kids in some of our communities hardest hit by crime and violence would benefit by coming into contact with young people enrolled in college. Students interested in getting involved can please leave your name and contact number in the comment field. (Note- comments are approved by an administrator before being posted to the blog. Your information will not appear on bpdnews.com)

We also welcome any other feedback you may have about last night's forum. Please feel free to leave a comment.

This is not an entirely new procedure; officers have always had the option to issue citations, but this new booklet streamlines and updates an existing process that was underutilized.

CHARLESTOWN MAN PLEADS GUILTY TO COLD CASE HOMICIDE

BOSTON, Feb. 16, 2006 – A longtime suspect in the 1981 homicide of Mary Theresa “Terry” Burhoe in Charlestown pled guilty to manslaughter today and was sentenced to the maximum penalty allowed under law, Suffolk County District Attorney Daniel F. Conley announced.

PATRICK JOHN DURHAM, 43 (D.O.B. 11/12/62), of Charlestown admitted that he was present when Burhoe, 14, was stabbed to death in the early morning hours of July 12, 1981. Burhoe’s body was discovered later that afternoon in a field near the Mystic River, about a half a mile from where she was last seen socializing with Durham and others. He was sentenced to a term of 19-20 years in state prison, a term recommended by prosecutors. Twenty years is the highest sentence the law allows for manslaughter.

During today’s hearing, Suffolk Superior Court Judge Margot Botsford heard a summary of the facts that the Commonwealth was prepared to prove: that Durham and Burhoe were among a group that was socializing at Carney Court in Charlestown in the hours preceding Burhoe’s death; that Durham threatened Burhoe with a knife at some point that evening; that Durham and Burhoe left Carney Court some hours later; and that nearly two decades after the crime, a forensic expert identified Durham’s DNA in a bloodstain left on Burhoe’s jeans.

Following the recitation of those facts, Botsford asked Durham if he agreed with those statements. “Yes, I do,” he responded.

Burhoe’s body was found in high grass at the corner of a field by the Little Mystic Channel, in the shadow of the Tobin Bridge. Prosecutors believe she was killed elsewhere and dumped there.
Prosecutors agreed to accept Durham’s plea to manslaughter after reviewing the provable evidence in its totality, assessing both the strengths of the case and the challenges inherent in prosecuting a 25-year-old case, and weighing those against their desire to ensure a conviction that would achieve some justice for the Burhoe family.

In sentencing Durham, Botsford acknowledged that she exceeded the Superior Court sentencing guidelines for manslaughter, giving the maximum sentence allowed under the law, to reflect the brutal nature of the crime. “This was a terrible crime, unquestionably,” she said.

Botsford also ordered that Durham receive credit for the six years he spent behind bars while awaiting his trial, which had been scheduled to begin early next month. Prosecutors had asked that Durham not get credit for most of that time, noting that until 2005 he was serving an 10-year sentence for an unrelated drug conviction.

Had the case gone to trial, Assistant District Attorney David E. Meier would have introduced evidence showing that Durham, then 18, was a knowing and willing participant in the chain of events that resulted in Burhoe’s homicide. Medical experts who would have testified that Durham, in the days following Burhoe’s stabbing, had lacerations on his fingers and human bite marks on his leg, and Boston police criminalists would have testified that DNA evidence recovered from Burhoe’s bloodstained pants matched Durham’s DNA profile.

Prior to sentencing Durham, Botsford heard victim impact statements by members of Burhoe’s family. Burhoe’s sister, Tina Marie Getchell, read from “Tears for Terry” – a poem that her mother wrote in 1996 about the pain of losing her daughter. “If only tears could bring her back,” Getchell read, “She would be here right now.”

Conley hailed the investigators who built the case against Durham and offered his thoughts for Burhoe’s family. “I only hope that today’s events bring some degree of finality and sense of justice to the loss they will endure for the rest of their lives,” he said.

Durham was first charged in connection with Burhoe’s death in 1981, when he was arraigned for assault and battery with a dangerous weapon for allegedly threatening Burhoe with a knife earlier on the night she was killed. Those charges were later dismissed, and investigators did not establish probable cause to charge Durham with Burhoe’s homicide until 2000, after he was implicated by the advanced DNA tests that had not been available to prosecutors at the time of the killing.
He has been held without bail on the homicide charge since that time.
